Description of Promotion
Welcome to the Refer-A-Friend, Give $25 Get $25 promotion (the “Promotion”), where participants and the referees they cause to sign up for a new Betr Sportsbook account using a referral link, will each receive a bonus available for use only on Betr Sportsbook (“Promotion Bonus”) equal to Twenty Five Dollars ($25) once the referee meets the requirements set forth herein.
By participating in this Promotion, you agree to be bound by these terms and conditions (“Promotion Official Rules”). Please read these Promotion Official Rules before entering the Promotion. Failure to comply with these Promotion Official Rules may, in the sole and absolute discretion of Sponsor, result in disqualification from the Promotion. You must meet the eligibility requirements and follow the Promotion Official Rules regarding participation as set forth herein. Sponsor reserves the right to cancel, suspend, or modify the Promotion at any time and from time to time in its sole and absolute discretion.
Sponsor: Betr Holdings, Inc., 290 NE 68th Street, Miami, FL 33138 (the “Sponsor”).
Eligibility: The Promotion is only open to individuals who are (i) at least 21 years of age and (ii) physically present in legal state. Employees of Sponsor, any prohibited participants (collectively, “excluded parties”), or any of the excluded parties’ advertising agencies, officers, directors, agents, and employees and their immediate family or household members are not eligible to participate in the Promotion. A person cannot be an eligible entrant or winner if such person is a person (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control (“OFAC”) of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List) or under any statute or executive order or (b) who is acting, directly or indirectly, for or on behalf of any such person. Individuals will be required to provide a valid identification and may be required to provide a valid taxpayer identification number or social security number to claim a prize.
Promotion Period: The Promotion Period will begin on January 1, 2023 and end on December 31, 2023.
Action Required: A referrer must obtain his/her unique referral link (“Referral Link”) from his/her Betr Sportsbook Sponsor Account and cause any referee to sign up (on his/her personal device) for a new Betr Sportsbook Account using such Referral Link and become verified for play on Betr Sportsbook, and meet the wager or entry requirement within twenty-eight (28) days of signing up (a “Referral”). For each legitimate and valid Referral, the referrer shall receive a Promotion Bonus equal to Twenty-Five Dollars ($25) and the referee shall receive a Promotion Bonus equal to Twenty-Five Dollars ($25) (collectively, the “Promotion Bonus”).
Promotion Bonus recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus received, regardless of whether the Promotion Bonus, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law.
CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION OR ANY GAME, INCLUDING ANY USE OF NON-PUBLIC INFORMATION OR OTHER CHEATING IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. Claiming Promotion Offer: The Promotion Bonus described herein will be issued in non-withdrawable cash that expires thirty (30) days after Sponsor credits the participant’s Sponsor Account. Unique user identity verification required. The Promotion ends at the conclusion of the Promotion Period.
Registration Procedure: To qualify for the Promotion, eligible individuals must have an active Sponsor account (“Sponsor Account”) and verify his/her identity in order to play on the Betr Sportsbook. Creating an account with Sponsor is free. By submitting your information and creating a Sponsor Account, however, participants will be required to agree to Sponsor’s Privacy Policy and applicable Terms and Conditions. If you do not agree to Sponsor’s Privacy Policy and applicable Terms and Conditions, you cannot create a Sponsor Account or participate in this Promotion.
Limitations on Participation: In addition to the eligibility requirements set forth above, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, in Sponsor’s sole and absolute discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law.
Eligible Games: All markets on the Betr Sportsbook are eligible to earn a Promotion Bonus, subject to these Promotion Official Rules.
Restrictions on Withdrawal: The Promotion Bonus is not transferable and cannot be substituted except in the Sponsor’s sole and absolute discretion. The Promotion Bonus is non-withdrawable, but any winnings therefrom are immediately withdrawable. Any unused portion of the Promotion Bonus will be automatically withdrawn from your Sponsor Account thirty (30) days after it is credited to your Sponsor Account. You may withdraw your deposited funds without penalty at any time.
Cancellation: Should you wish to cancel your participation in this Promotion at any time, please contact Sponsor Customer Support via support.betr.app. Upon cancellation, you may withdraw any funds you have deposited into your account without restriction. However, any Promotion Bonus amount in your account may not be withdrawn.

Administration: Sponsor reserves the right to cancel, suspend, or modify the Promotion at any time and from time to time in its sole and absolute discretion without prior notice or consent. Administration of this Promotion is at the sole and absolute discretion of the Sponsor. Sponsor reserves the right to restrict at any time any Sponsor Account holder from participating in this Promotion for any reason. Any questions relating to eligibility, these Promotion Official Rules, or any other questions concerning this Promotion will be resolved at the sole and absolute discretion of the Sponsor and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Promotion Official Rules to their members.
Release and Waiver of Liability: By participating in this Promotion, participants agree to release, defend, indemnify, and hold harmless the Sponsor, its affiliates, subsidiaries, directors, officers, employees, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives, and agents (collectively, “Released Parties”) from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages, or losses to persons and property which may be sustained in connection with: (i) participation in the Promotion; and (ii) the receipt, use, or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by Sponsor’s own negligence. The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus. In consideration of the Promotion Bonus, each individual hereby agrees and consents, without further authorization, compensation, or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information, and statements concerning the Promotion, in any and all advertising, promotions, and other publicity conducted by the Sponsor and its affiliates or subsidiaries.
Dispute Resolution & Arbitration: In the event of any disputes, claims, and causes of action arising out of or in connection with this Promotion, including but not limited to any Game or any prize, or the breach, enforcement, interpretation, or validity of these Promotion Official Rules or any part of it (each, a “Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party thirty (30) days in which to respond to or settle the Dispute. Notice of a Dispute shall be sent to: (a) Sponsor, at Betr Holdings, Inc. d/b/a Betr, 290 NE 68th Street, Miami, FL 33138, or (b) you, at the address we have on file for you. Both you and the Sponsor agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS AS DESCRIBED BELOW. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you or the Sponsor would otherwise have in court will not be available or will be more limited in arbitration, including discovery and appeal rights. All such Disputes shall be exclusively submitted for binding arbitration under the rules of the American Arbitration Association (“AAA”) then in effect, before one arbitrator to be mutually agreed upon by both parties (or, if not agreed within 30 days of the first party proposing an arbitrator, determined under AAA rules). The Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration. THE AWARD DETERMINED BY THE ARBITRATION WILL BE FINAL AND BINDING, EXCEPT FOR ANY RIGHT OF APPEAL PROVIDED BY THE FEDERAL ARBITRATION ACT, AND MAY BE ENTERED IN ANY COURT HAVING JURISDICTION OVER THE PARTIES FOR PURPOSES OF ENFORCEMENT. The place of such arbitration shall be either Miami-Dade County, Florida or the U.S. county of your residence, and the proceedings shall be held there, except to the extent otherwise agreed to by the parties. In the event that you initiate arbitration in the county of your residence, the entity you have a Dispute with may transfer the arbitration to Miami-Dade County, Florida in the event that it agrees to pay the additional fees or costs you incur as a result of the change in location as determined by the arbitrator.
Notwithstanding anything to the contrary herein, Sponsor’s customer services team will respond to any complaint or dispute received within a maximum of ten (10) calendar days from the day the complaint is received. Sponsor will additionally update you via email every ten (10) calendar days of the status for any ongoing dispute that is active.
Governing Law: These Promotion Official Rules shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to Florida’s conflict of law principles. Any Disputes not subject to the arbitration provision discussed above shall be resolved exclusively in the federal or state courts sitting in Miami-Dade County, Florida, and you expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts for purposes of litigating any such claim or action. Each participant agrees to service of process by mail or other method acceptable under the laws of the State of Florida. All participants agree to abide by the terms of these terms and conditions and the decisions of the Sponsor hereunder, which are final, and waive any right to claim ambiguity in these terms and conditions. In the event any party challenges a term or provision of these Promotion Official Rules, the party hereby expressly waives any and all opportunities to recover any amount from Sponsor and the Released Parties relating to this Promotion or otherwise.
LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Severability: You agree that these Promotion Official Rules are severable. If any term or provision is declared invalid or unenforceable, in whole or in part, that term or provision will not affect the remainder of these Promotion Official Rules. These Promotion Official Rules will be deemed amended to the extent necessary to make these Promotion Official Rules enforceable, valid and, to the maximum extent possible, consistent with applicable law and consistent with the original intention of the parties; and the remaining terms and provisions will remain in full force and effect. If any provision of these Promotion Official Rules is found by a court of competent jurisdiction to be invalid, Sponsor will amend or replace such provision with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of Sponsor as reflected in the original provision. The invalidity or unenforceability of any provision of these Promotion Official Rules does not affect the validity or enforceability of any other provision of these Promotion Official Rules, which will remain in full force and effect.
Headings: The section headings contained in these Promotion Official Rules are for convenience only and shall not be considered in the interpretation or construction of the provisions of these Promotion Official Rules.
Waivers: No waiver of any of the provisions of these Promotion Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Promotion Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Promotion Official Rules, which will otherwise remain in full force and effect.
